Higher regional court Munich confirms judgement for interest fund investors against investment consultants

(openPR) - Augsburg, 2.02.2007 - the higher regional court Munich confirmed our judgement of the regional court Munich I and to our mandator finally requirements because of incorrect investment advice awarded.

The plaintiff took part in the closed real estate fund „Falk interest fund society of civil right “of the Falk group in Munich. This fund served for it, the bridging finance other closed real estate funds for realizes, since this was no longer possible over banks. Approximately 58 million euro by over 2000 capital investors one in-collected and one assigned up to approximately 9 million euro to different funds in the form of unbesicherten loans.

The fund folder of March 2003 cleared up over the substantial risks. The plaintiff desired repayment of his performed insert, since he was advised of the sales representatives of the deplored one wrongly and incompletely. The hearing of evidence resulted in that the plaintiff thereby was recruited that the money was as safe in the fund as time deposits however evenly with safe 8% interest. It was not cleared up over the fact that he does not have a requirement on the repayment of his insert, however he referred to with the consultation, to need the entire capital at short notice again. Likewise it was not mentioned that the loans of the interest fund are not to be besichert. It was recruited with the good name by „Falk “and the many real estates. The folder was not handed over before signing.

After the decision of the regional court Munich I the deplored one clings to the plaintiff on payment of damages, because the consultation of its sales representatives was not investor fair. It was directly wrong and incomplete.

The higher regional court Munich confirmed this judgement in its decision of 1.02.2007. For the court it gave no doubts about the erstinstanzlichen legal concept and the reliability to the witness.
