(openPR) - secret Vaterschaftschaftstests cannot be used before court further. That decided the Federal Constitutional Court in its judgement from 13 February 2007 (Az: 1 BvR 421/05).
The legislator must open however a simpler way to the fathers to examine doubts about the biological descent of their new generation by a legal gene test. Because the right of child and nut/mother to abandon gene data not is in principle less protect worth the Karlsruher judge than the requirement of the alleged father on knowledge of the descent, judged. Up to 31. March 2008 must be issued an appropriate law. A legal procedure is to be created, which is limited to the examination of the biological descent. Bare doubts of the man, who is considered legally as a father, are to be sufficient for it. So far men must have sound notes for it, which speak against their role as producers. In addition they can contest only the paternity completely - with the consequence that they lose any legal relationship with the child.
With the new statement procedure fathers are doubts to eliminate, at the same time however legal “father” to remain to be able, if they want this.
